Register for a Class

I, (Participant or Parent if Participant is under 18 years of age), know that dancing (whether joining in-person or online classes) is an activity that carries risk of injury or property damage. I also know there are natural, environmental, or other conditions and risks, which independently or in combination with my activities may cause property damage or injury to others or me. I agree while engaged in dance or any activity associated with or relating in any way to Fusion Dance, Inc. I am alone responsible for: (a) the safety of my property and myself; (b) acting in a reasonable and responsible manner to safeguard others and their property; and (c) providing, utilizing and maintaining that equipment and those accessories reasonably necessary for the safe enjoyment of my participation in such activities. I also acknowledge Fusion Dance, Inc., its directors, officers, employees, agents, representatives, organizers, and promoters are not responsible for my safety. In advance then, I specifically RELEASE AND DISCHARGE those parties from any and all liability, whether known or unknown, even if that liability should arise out of negligence or carelessness on the part of those persons or entities mentioned above. Being fully aware of the risks, conditions and hazards of dancing or any activities associated with or relating in any way to Fusion Dance, Inc., I HEARBY AGREE TO WAIVE, RELEASE, AND DISCHARGE any and all claims for damages to personal property or resulting from personal injury which I may have or which may hereafter accrue to me as a result of any participation in dance or any activities associated with or relating in any way to Fusion Dance, Inc., whether such damage or injury was foreseeable or not, including but not limited to any such claims regarding the design or condition of any equipment or accessories utilized by me in such activities regardless of whether such equipment or accessories are specified or recommended by such person or entities identified above. I further agree to HOLD HARMLESS AND IDEMNIFY all persons and entities identified above, generally and specifically, from any and all liability for personal injury or property damage resulting in any way from my participation in dance or any activities associated with or relating in any way to Fusion Dance, Inc. I currently have, and I agree to maintain throughout the time I participate in dance or any activities associated with or relating in any way to Fusion Dance, Inc., valid and sufficient health and accident insurance. I understand this is my sole responsibility and RELEASE all persons and entities identified above from providing this coverage for me. This Acknowledgement, Assumption of Risk, and Release shall be binding upon by heirs and assigns. By signing the Acknowledgement, Assumption of Risk, and Release as Parent/Guardian, I am consenting to all of the above listed acknowledgements and agreements.

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Fusion Dance, Inc. has put in place preventative measures to reduce the spread of COVID-19; however, Fusion Dance, Inc. cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending Fusion Dance, Inc. could increase your risk and your child(ren)’s risk of contracting COVID-19. By signing the Acknowledgement of the Risk and Waiver of Liability Relating to Coronavirus/ COVID-19 as Participant or Parent/Guardian, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Fusion Dance, Inc. and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Fusion Dance, Inc. may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Fusion Dance, Inc. employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Fusion Dance, Inc. or participation in Fusion Dance, Inc. programs (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Fusion Dance, Inc., its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Fusion Dance, Inc., its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Fusion Dance, Inc. program, class or event.
